1. Introduction

Purpose of this document: These Terms of Use (“Terms”) govern the day-to-day access and use of the Eskoler platform by all individual users. About Eskoler: Eskoler is a comprehensive educational management, communication, and logistics platform designed for schools, parents, students, and staff. Applicability: These Terms apply universally across all Eskoler domains, subdomains, mobile applications, APIs, and any future services provided by us. Relationship with other documents: These Terms work in conjunction with our Master Terms & Conditions (which govern the institutional agreement with the School) and our Privacy Policy. In the event of a conflict regarding institutional obligations, the Master Terms & Conditions shall prevail.

2. Acceptance of these Terms

Binding agreement: By accessing, downloading, or using any part of the Eskoler platform, you agree to be bound by these Terms. Age requirements: Users must be of legal age to form a binding contract. Minors may only use the platform under the authorization and supervision of a parent, legal guardian, and their educational institution. Institutional acceptance: If you are accessing the platform on behalf of an educational institution, you represent that you have the authority to bind that institution to these Terms.

3. Eligibility to Use Eskoler

Eligible users: The platform is restricted to authorized Schools, School administrators, Teachers, Students, Parents/Guardians, Drivers, and administrative Staff. Authorized institutional access: Access is primarily granted and managed by the subscribing School. Jurisdiction limitations: The platform is operated from India. Users accessing the platform from other jurisdictions are responsible for compliance with local laws.

4. User Accounts

Account creation & Accuracy: You must provide accurate, current, and complete information during registration. One account per individual: You may only maintain one active account unless explicitly authorized by your School (e.g., a Teacher who is also a Parent). Responsibility & Verification: You are solely responsible for maintaining the confidentiality of your credentials. Eskoler and your School reserve the right to require account verification (e.g., OTP or email confirmation). Account recovery: Recovery procedures must follow the security protocols established by Eskoler and your School administrator.

5. User Responsibilities

You agree to keep your account information accurate, maintain password security, and immediately report any unauthorized access or suspected breaches to your School administrator and Eskoler support. You must comply with all applicable laws and your School’s internal policies while using the platform.

6. Appropriate Use of the Platform

The platform is provided strictly for:

  • Educational & Administrative purposes: Managing academics, grades, and school operations.
  • Communication: Facilitating official school-related dialogue.
  • Transport services: Tracking authorized school vehicles.
  • Marketplace usage: Procuring educational materials and school merchandise.
  • AI assistance: Utilizing educational AI tools responsibly.
  • Attendance services: Managing student and staff presence.

7. Prohibited Activities

You are strictly prohibited from engaging in the following:

  • Illegal activities & Harassment: Engaging in unlawful acts, cyberbullying, or harassment.
  • Malware & Unauthorized access: Uploading viruses, attempting to breach platform security, or accessing data belonging to others.
  • Technical abuse: Reverse engineering the software, data scraping, or attempting to bypass security/moderation controls.
  • Account abuse: Credential sharing, creating fake accounts, or impersonation.
  • Feature abuse: Misuse of AI tools, fraudulent payments, and misuse of facial recognition or GPS tracking features for non-educational or stalking purposes.
  • Unlawful content: Uploading explicit, discriminatory, or unauthorized copyrighted material.

8. School Responsibilities

Schools act as the data controllers and administrators and are responsible for:

  • Maintaining accurate student and staff records.
  • Obtaining all necessary, legally compliant parental permissions (especially for minors, facial recognition, and GPS tracking).
  • Providing lawful data and managing user access/revocations promptly.
  • Ensuring compliance with all applicable educational and privacy regulations.
  • Promptly executing account deletion requests in accordance with data retention laws.

9. Parent & Guardian Responsibilities

Parents and guardians must protect their login credentials, actively monitor their child’s usage of the platform, provide accurate emergency and contact information, regularly review school notifications, and respect the official communication channels established by the School.

10. Student Responsibilities

Students must use the platform exclusively for educational purposes. Students are expected to uphold academic integrity (including the transparent use of AI tools), conduct themselves respectfully in all digital interactions, and use school-issued or personal devices responsibly while accessing Eskoler.

11. Teacher & Staff Responsibilities

Educators and staff must strictly maintain the confidentiality of student data (including grades and behavioral notes), handle all Personal Data in accordance with school policy and law, communicate respectfully with parents and students, and use administrative privileges solely for their intended operational purposes.

12. Driver Responsibilities

Drivers using the transport module must ensure accurate GPS usage by keeping the app active during routes. Drivers must not manipulate or spoof GPS data, must practice safe device usage (never interacting with the app while the vehicle is in motion), and must comply fully with all school transport and local traffic policies.

13. Communications

By using the platform, you consent to receive official communications via Email, SMS, Push notifications, In-app notifications, and WhatsApp (where supported by the School). Emergency notifications will bypass standard opt-out preferences to ensure student safety.

14. Content Submitted by Users

Ownership & Responsibility: You retain ownership of the content you submit (documents, homework, photos, assignments), but you are entirely responsible for its accuracy and legality. License: You grant Eskoler and the School a license to host, display, and distribute this content as necessary to provide the platform’s features.

15. Intellectual Property

All rights to the Eskoler software, logos, branding, designs, source code, documentation, and mobile applications remain the exclusive property of Eskoler. You are granted a limited, revocable license to use the platform; no ownership rights are transferred to you.

16. Artificial Intelligence Features

Educational assistance & Limitations: AI features are provided as educational aids. They may occasionally generate inaccurate or biased content. Human verification: Users are responsible for reviewing and verifying all AI-generated content before relying on it or submitting it for academic credit. Academic integrity: Students must follow their School’s specific policies regarding the disclosure and use of AI tools for assignments.

17. Facial Recognition Features

Purpose & Consent: Facial recognition is used strictly for attendance automation and media organization (e.g., sorting school photos). Schools are legally obligated to obtain explicit consent before enrolling any user in these features. Accuracy & Access: Eskoler makes no absolute guarantees regarding the accuracy of facial recognition. Access to biometric data is strictly controlled and authorized.

18. Vehicle Tracking

Purpose: GPS tracking is provided solely for educational transport visibility and student safety. Driver consent & Parent visibility: Drivers consent to live location sharing during active routes. Parents may only view the location of the vehicle to which their child is assigned.

19. Marketplace Services

The Marketplace facilitates the purchase of school merchandise and educational products. Eskoler provides the platform but is not responsible for product availability, fulfillment, pricing accuracy, or returns unless Eskoler is the direct seller of record.

20. Advertising

The platform may display advertisements on designated domains (e.g., ads.eskoler.com). Eskoler strictly prohibits targeted advertising directed at Student accounts. All sponsored content will be clearly identified.

21. Payments

Users and Schools are responsible for all subscription payments, shop purchases, and associated taxes. Eskoler reserves the right to suspend access to premium features or Marketplace orders in the event of failed or fraudulent payments.

22. Availability of Services

Eskoler will perform planned maintenance (with notice where possible) and emergency maintenance as required to ensure security. We do not guarantee 100% uptime, and the platform may experience downtime or feature updates that change functionality.

23. Third-Party Services

The platform may feature limited integrations or external links to independent third-party services (e.g., payment processors, external curriculum providers). Eskoler disclaims all responsibility for the availability, security, or data practices of these independent services.

24. Privacy & Data Protection

Your data is handled in strict accordance with our Privacy Policy and the Digital Personal Data Protection Act, 2023 (DPDP) of India. We prioritize children’s privacy, enforce strict security commitments, and uphold user rights regarding data access and correction.

25. Security

Users are obligated to use secure passwords and enable multi-factor authentication where available. Users must promptly report any discovered security vulnerabilities to Eskoler and refrain from exploiting them.

26. Suspension & Termination

Eskoler or the School may suspend or permanently terminate your account for fraud, abuse, violation of these Terms, or upon receipt of valid legal requests. Schools may also request the suspension of specific user accounts at their discretion.

27. Account Deletion

Users may request account deletion through their School administrator. Schools are responsible for verifying the request. Deletion and data retention will be handled in accordance with the DPDP Act and educational legal obligations. Once permanently deleted, data restoration is limited or impossible.

28. Updates to the Platform

Eskoler continuously improves the platform. We reserve the right to introduce new features, retire older features, and mandate mobile application updates to maintain version compatibility and security.

29. Disclaimer of Warranties

The platform is provided on an “as is” and “as available” basis. Eskoler makes no guarantee of uninterrupted availability and specifically disclaims any warranty that the educational support tools will result in specific academic outcomes.

30. Limitation of Liability

To the maximum extent permitted by law, Eskoler shall not be liable for indirect damages, service interruptions, inaccuracies in School-provided data, or any issues arising from user-generated content.

31. Indemnification

You agree to indemnify and hold Eskoler harmless from any third-party claims arising out of your breach of these Terms, your misuse of the platform, or any content you submit. Schools hold separate indemnification responsibilities as outlined in the Master Terms & Conditions.

32. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of India, specifically including applicable state laws where Eskoler’s operations are headquartered.

33. Dispute Resolution

Any disputes shall first be attempted to be resolved through internal resolution and mediation. If unresolved, disputes will be subject to binding arbitration or the exclusive jurisdiction of the competent courts in the Republic of India.

34. Changes to these Terms

Eskoler may update these Terms periodically. The effective date will be posted at the top of this document. We will provide notification of material changes, and your continued use of the platform constitutes acceptance of the new Terms.
